2016 Spending Bill
Congress passed the Spending Bill provisions, expressly prohibiting the government from spending funds in contravention of the Farm Bill and thus, prohibiting the DEA from interfering with the interstate transportation of industrial hemp grown pursuant to the Farm Bill. See Consolidated Appropriations Act, 2016 Pub. L. No. 114-113, Section 763, 129 Stat. 1175, 2285 (2016).
As such, pursuant to the 2016 Spending Bill, Industrial hemp may be processed, transported to and sold in states that have not enacted industrial hemp laws pursuant to the 2014 Farm Bill. See also USA v. Marin Alliance for Medical Marijuana.
